In using this Website you are deemed to have read and accepted the Conditions regardless of whether you choose to register with GBK via the Website. If you do not accept these Conditions, do not use this Website. These Conditions are issued by Gourmet Burger Kitchen Limited (“GBK”)
Access and use of this Website is provided by GBK. Reference in these Conditions to “you” and “your” refers to you, the person accessing this Website.
1. Introduction
1.1 You may access most areas of the Website without registering your details with us. Certain areas of the Website are only open to you if you register.
1.2 By accessing any part of the Website, you shall be deemed to have accepted these Conditions in full. If you do not accept these Conditions in full, you must leave the Website immediately.
1.3 GBK may revise these Conditions at any time by updating this posting. You should check the Website from time to time to review the then current Conditions, because it is binding on you. Certain provisions of these Conditions may be superseded by expressly designated legal notices or terms located on particular pages on the Website.
2. Privacy Statement
GBK is committed to protecting your privacy. Authorized employees within GBK shall only have access to your personal data on a need to know basis and will only use such information in accordance with our Privacy Statement.
3. Registration
3.1 Each registration is for a single user only. GBK does not permit you to share your user name and password with any other person nor with multiple users on a network.
3.2 Responsibility for the security of any passwords issued rests with you.
3.3 You warrant that:
(a) The personal information which you are required to provide when you register as a GBK Gang member (the “Personal Information”) is true, accurate, current and complete in all respects; and
(b) You will notify us immediately of any changes to the Personal Information by contacting our us at thegang@gbk.co.uk.
3.4 You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
4. Our rights
GBK reserves the right to modify or withdraw, temporarily or permanently, the Website (or any part thereof) with or without notice to you and you confirm that GBK shall not be liable to you or any third party for any modification to or withdrawal of the Website.
5. Service Access
5.1 While GBK endeavours to ensure that the Website is normally available 24 hours a day, GBK shall not be liable if for any reason the Website is unavailable at any time or for any period.
5.2 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond GBK’s control.
6. Visitor Material and Conduct
6.1 Other than personal data, which is covered under our Privacy Statement, any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. GBK shall have no obligations with respect to such material. 13. Waiver
Failure of either Party to insist upon strict performance of any provision of these Conditions or the failure of either Party to exercise any right or remedy to which it is entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under these Conditions. No waiver of any of the provisions of these Conditions shall be effective unless it is expressly stated to be such and signed by the party giving the waiver.
14. Survival
Each provision of these Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
15. Entire Agreement
You acknowledge that in accepting these Conditions, you have not relied on any representation save insofar as such representations have expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these Conditions.
16. Law
These Conditions shall be governed by and construed in accordance with English law and any disputes arising in connection with these Conditions shall be subject to the exclusive jurisdiction of the English courts.

GBK GENERAL PRIZE DRAW TERMS AND CONDITIONS
1. These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules ("Rules") and apply to competitions on the GBK "Site"("Prize Draw"), unless otherwise expressly stated. By entering a Prize Draw, entrants agree to be bound by these Rules.
2. The Prize Draw is organised by Gourmet Burger Kitchen 1 Lindsey Street Suite C 2nd Floor London EC1A 9HP
3. Rules specific to each prize are displayed in a notice on the page for such Prize Draws ("Competition Notice") and are incorporated into the Rules. In the event of differences or discrepancy between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.
4. GBK reserves the right to cancel or amend the Competition or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside GBK's reasonable control. Any changes will be posted either within these terms and conditions or the Competition Notice. 5. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of GBK shall be final and no correspondence or discussion shall be entered into.
Qualifying Entrants
6. Employees (or members of the families or households of employees) of GBK or any company involved in the Competition, or any advertising agency or web company connected with the Competition or any such person’s subsidiary or associated companies, are not eligible to enter the Competition. GBK reserves the right not to award a prize (and to select an alterative winner) if GBK is aware or has reasonable grounds to believe that a winner is not eligible.
7. Additional eligibility requirements may apply to a specific Competition, e.g. a valid passport, visas and/or driver’s licence will be required if the prize includes travel outside the United Kingdom and/or car hire. These will be set out in the Competition Notice.
8. By entering the Draw, you hereby warrant that all information submitted by you is true, current and complete. GBK reserves the right to verify the eligibility of all entrants.
9. The address you provide as a winner ("Entry") will be used to send any prizes so please make sure this is correct. Unless stated otherwise in the Competition Notice, Competitions are only open to residents of the United Kingdom and you are not entitled to enter the Competition if you are resident outside of the United Kingdom. Where a Competition is open to entrants from outside the United Kingdom, you are not entitled to enter the Competition if you are resident in a country or jurisdiction where the Competition may breach any law or regulation. Where this applies, GBK’s invitation to enter the Competition in such country and/or jurisdiction is withdrawn.
10. Where a Competition is open to all age groups, GBK assumes that by using the website and entering the Draw (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Draw and these Rules. If a Prize Draw is only open to a certain age group (e.g. 18 and over), this will be set out in the Competition Notice and GBK assumes that by entering the Draw (and you warrant that) you are the appropriate age to enter the Draw).
11. GBK reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
12. In the event that any entrant is disqualified from the Draw, GBK in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
Competition Entries
13. Unless stated otherwise in the Competition Notice, you may enter the Competition as many times as you like however where a winner has been selected and GBK discovers or has reasonable grounds to believe the winner has used any software or automated process either to answer questions or to make bulk entries, GBK may select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Rules.
14. Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.
15. There is no purchase requirement to enter a Prize Draw and there is no charge to register for use of the website.
16. Proof of posting or emailing cannot be accepted as proof of delivery. GBK cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorized access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside GBK’s control.
Prizes
17. Unless stated otherwise in the Competition Notice, prize winners will be chosen at random from all correct Entries (for competitions involving answering questions or where entry is by emailing or otherwise providing a name and/or contact details to GBK) or from all submitted entries (where creative or artistic merit or other subjective criteria apply to entries (unless these are being judged as set out in the Competition Notice)), within 28 days of the closing date specified in the Competition Notice.
18. Prize winners will be notified in the manner and within the time specified on the Competition Notice (and may be contacted by GBK or GBK’s nominated supplier(s)). Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the website or you can write to Competition Prize Winners, Gourmet Burger Kitchen 1 Lindsey Street Suite C 2nd Floor London EC1A 9HP naming the specific competition including a self-addressed stamped envelope for a list of winners.
19. Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
20. Prizes are non-transferable and there is no cash alternative. GBK reserves the right to substitute prizes of equal or greater value at any time
